These Terms of Service apply to the website, Shopify store, merchandise, donations, sponsorships, event registrations, digital products, forms, programs, content, and related online services operated by Gamerz Dojo Foundation.

By visiting our website, using our Shopify store, placing an order, making a donation, becoming a sponsor, registering for an event, creating an account, submitting a form, or otherwise interacting with our services, you agree to these Terms of Service.

If you do not agree to these Terms of Service, please do not use our website, Shopify store, or related services.

1. About Gamerz Dojo Foundation

Gamerz Dojo Foundation is a nonprofit 501(c)(3) organization created to support youth, families, gamers, and the community through gaming, education, mentorship, healthy gaming culture, community programs, events, fundraising, and related nonprofit initiatives.

Unless otherwise stated, 100% of proceeds from sales, donations, and sponsorships processed through our website or Shopify store are deposited directly into the Gamerz Dojo bank account and used to support our charitable mission, programs, events, education initiatives, community outreach, and related nonprofit operations.

2. Eligibility to Use Our Services

By using our website, Shopify store, or related services, you represent that you are at least the age of majority in your state or jurisdiction, or that you are using our services with the involvement and consent of a parent or legal guardian.

Our Shopify store is intended for use by adults, parents or guardians, donors, sponsors, supporters, customers, and individuals legally able to make purchases, donations, sponsorships, or registrations.

Youth-focused programs, events, educational activities, mentorship opportunities, gaming activities, or community initiatives may require additional registration forms, waivers, parent or guardian consent, safety policies, or participation agreements.

3. Purchases, Donations, Sponsorships, and Payments

Our website or Shopify store may allow you to purchase merchandise, digital products, event-related items, fundraising products, tickets, registrations, sponsorships, donations, or other offerings.

By placing an order, making a donation, becoming a sponsor, or completing a transaction, you agree to provide current, complete, and accurate billing, shipping, contact, and payment information.

You authorize us and our third-party payment processors to charge the payment method you provide for the total amount shown at checkout, including applicable taxes, shipping charges, fees, or other amounts disclosed before purchase.

We reserve the right to refuse, cancel, limit, or refund any order, donation, sponsorship, registration, or transaction where necessary, including in cases of suspected fraud, payment issues, pricing errors, inventory issues, policy violations, misuse of our services, or other operational concerns.

4. Donations, Tax Deductibility, and Sponsorships

Donations may be tax-deductible to the extent allowed by law. Purchases of merchandise, digital products, event tickets, sponsorships, registrations, or other goods and services may not be fully tax-deductible because goods, services, promotional value, event access, or other benefits may be received in exchange.

Gamerz Dojo Foundation does not provide tax, legal, accounting, or financial advice. Please consult your own tax advisor, accountant, or legal professional regarding the deductibility of any donation, sponsorship, purchase, or contribution.

Donations and sponsorships are generally non-refundable once processed unless there is a duplicate transaction, processing error, unauthorized transaction, incorrect amount, event cancellation, material change, or another circumstance required by law or approved by Gamerz Dojo Foundation.

5. Product Information and Availability

We make reasonable efforts to provide accurate product descriptions, pricing, images, sizing information, availability, shipping estimates, event details, donation information, sponsorship information, and program details.

However, we do not guarantee that all information on our website or Shopify store will always be complete, accurate, current, or error-free.

We reserve the right to correct errors, update information, change prices, update product details, modify availability, cancel orders, discontinue products, modify programs, update events, or change offerings at any time.

Product colors, sizing, images, mockups, materials, and display details may vary based on your screen, device, vendor, print provider, fulfillment partner, or production process.

6. Order Processing and Shipping

Our regular business hours are:

Monday – Friday
10:00 AM – 5:00 PM MST

Our daily order cut-off time is 2:00 PM MST.

Most orders are processed within 24 hours during regular business days. Orders placed after 2:00 PM MST, on weekends, or on holidays will begin processing on the next business day.

Shipping times vary depending on the destination state, shipping zone, carrier, shipping method, product availability, fulfillment partner, and other factors outside of our control.

Shipping, tracking, delayed orders, incorrect addresses, missing packages, and related delivery issues are governed by our posted Shipping Policy.

7. Returns, Exchanges, and Refunds

Returns, exchanges, refunds, damaged items, defective items, incorrect items, digital products, donations, sponsorships, event registrations, and final-sale items are governed by our posted Return Policy and Shipping Policy.

Customers are responsible for reviewing these policies before placing an order, making a donation, becoming a sponsor, or registering for an event.

We reserve the right to deny returns, exchanges, or refunds that do not comply with our posted policies, unless otherwise required by law.

8. Digital Products and Downloads

Digital products, downloads, online resources, courses, documents, templates, guides, or electronically delivered materials may be made available through our website or Shopify store.

Digital products are generally final sale once access has been provided or the file has been delivered, unless otherwise stated or required by law.

You may not copy, share, resell, redistribute, upload, publish, modify, or commercially exploit digital products or downloadable materials unless you have written permission from Gamerz Dojo Foundation.

If you experience a technical issue accessing a digital product, please contact us so we can help resolve the issue.

9. Events, Programs, and Registrations

Gamerz Dojo Foundation may offer events, tournaments, workshops, classes, mentorship opportunities, gaming activities, volunteer opportunities, fundraisers, programs, sponsorship opportunities, or community activities.

Event tickets, tournament registrations, program registrations, vendor fees, sponsorship tables, or similar event-related purchases may be subject to additional terms listed on the event page, registration form, waiver, consent form, or participation agreement.

Unless otherwise stated, event tickets and registrations are generally final sale.

If Gamerz Dojo Foundation cancels or materially changes an event, we may offer a refund, credit, transfer, rescheduled date, or other resolution depending on the nature of the event and applicable law.

10. Customer Accounts

If customer accounts, member accounts, or login features are available, you are responsible for maintaining the confidentiality of your account credentials, password, and access information.

You agree to provide accurate account information and to update it when necessary.

You are responsible for all activity that occurs under your account. If you believe your account has been accessed without authorization, please contact us immediately.

We reserve the right to suspend, limit, or terminate accounts that violate these Terms of Service, our policies, applicable law, or the rights of others.

All logos, names, graphics, designs, images, product artwork, written content, videos, downloads, digital resources, program materials, slogans, branding, and other content on our website or Shopify store are owned by Gamerz Dojo Foundation, licensed to Gamerz Dojo Foundation, or used with permission unless otherwise stated.

You may not copy, reproduce, modify, distribute, sell, display, upload, publish, or use our content, branding, logos, designs, or materials without prior written permission from Gamerz Dojo Foundation.

Unauthorized use of our intellectual property is prohibited.
